In recent months, there has been a lot of talk about the changes introduced by Simplex Urbanístico, leading many owners and buyers to believe that the License of Use is no longer necessary to sell a property. However, this is not true.

 

What has changed?

Recent legislative changes have simplified some procedures associated with the transfer of real estate, eliminating, in certain situations, the obligation to present the License of Use at the time of the deed.

However, this administrative simplification does not change a fundamental principle: the urban situation of the property continues to be decisive for a safe purchase.

 

The License of Use therefore continues to exist.

In practice, the absence of this document can no longer in itself prevent the deed from being carried out. However, this does not mean that the property is automatically regularized from an urban point of view and, therefore, it is essential to check some aspects.

It is essential to confirm that all the documentation of the property is in compliance and reflects your reality, such as:

  • The existence of the License or Title of Use, when applicable;
  • Any exemption by seniority;
  • The conformity between the current use and the authorized use;
  • The legalization of expansions, annexes or changes made over time;
  • The correspondence between the physical reality of the property and the elements contained in the official documentation.

 

Careful analysis at this stage of the purchase can avoid delays, unexpected costs and future embarrassments.

 

If there is financing and, although the legislation has simplified some procedures, banking institutions continue to carefully assess the urban situation of the properties before granting housing credit, as a form of collateral.

Depending on each operation, documents such as the License of Use, exemption statements, certificates of seniority or other proof of urban regularity may continue to be requested in the process.

 

Regardless of the legislative changes, gathering all the documentation of the property in advance remains one of the best ways to ensure a simpler, more transparent and safer process. It speeds up credit approval, reduces the risk of unforeseen events and conveys greater confidence to all parties involved.
